Multiple H1 Stamping
Hi guys
I have a query; I had applied for H1 visa (2007 2008) from 2 places
One from my current working company and another from consultancy firm in US. I got through the lottery from both the places. I have done my stamping for the visa from consulting firm.
Now my question is will I be allowed to go for stamping again . What are my options now if I want my visa stamped from my current working company .

Silvergate did academic evaluation for me for my I-140 and they did an excellent job on my case which i needed rushed and they gave me efficient next day processing. I had contacted other evaluation services first who would take longer and were more expensive. I definitely recommend them.

With USCIS filing fees spewing higher than the BP oil spill, you'd think the President and Congress would be holding press conferences to propose a legislative fix. But, alas, immigrants cannot vote, so who cares? Perhaps their U.S. citizen spouses, parents, sons and daughters, siblings and employers who have sponsored them for green cards and temporary working visas. Also, the Immigration Examiners who may lose their jobs as ever-higher filing fees deter immigrants from applying for naturalization and other immigration benefits. Back when I worked as an INS Citizenship Attorney, the cost of applying for U.S. citizenship was a mere...

Hello,
I would like to prepare for the worst scenario that might happen in near future since I only got about two months of H1B
I didn't even know what " RFE" was until I recently received it. From my first H1B app to LC, things have gone so smoothly.. but now I am starting to realize that this could be jeopardize my whole career in U.S if I don't get approved from I140.
When I started my PERM processing last year,my lawyer made sound so easy about getting a GC that the paralegal who handles my case has never told me anything about" if things goes wrong",which I am afraid that it might be happen soon...
If I get denied from I140, Is there a way to extend my H1B ? or any other way to keep my job in U.S legally ? Could anyone give me some advice ?
my status:
Apr 2009 Priority Date EB2
May 2010 I140 EB2 filed
May 2010 I1485 filed
July 2010 I140 RFE
H1B 6th year (exp. OCT1 2010)

I have a EB3 case from employer A, and an EB2 case as a future GC from employer B , and got the date ported from EB3 case to EB2 , got EAD and AP .Now I have started working for employer B on EAD, for the past 3 months, and now my contract might expire with the client and loose job, I have found an other job , but have to leave employer B, now my question is, can I file AC21 and leave my GC sponsoring company(employer B), or is it a very short time , and raise any doubts on being a "NO GOOD FAITH"case. Please help. All I 140's are approved.

I am an analyst under H1B and I am involved in a sales process by developing a prototype for a client. My company wants me to give a percentage of total deal as commission. It will show in the pay stub as commission. Is it legal to get commission under H1B (please remember I am a programmer analyst) ?
As long as the payment comes from/through the company that is sponsoring your H1B, you're fine.

I have a few questions here.
1. Does it really matter what date the 485 application was filed, if it was filed within the specified time-period ?
I mean, will it matter if someone applied for 485 on July 30th or August 17th, other than trying for an EAD and AP earlier ?
2. Is there a benefit of applying early in the timeframe, in getting an approved 485 ?
Please respond at your convenience.

Guys, My appeal "I290B" for a denied I140 under EB3 category was submitted on March 5th 2008 to TEXAS service center AAO.
I have 2 questions in tracking the application
1) Are all I290B's processed initially where I140 is denied and then later sent to DC office, or completely processed by TSC.
2) If the applications are sent to DC after review by TSC. how long does TSC take to review the application before forwarding to DC and how long will DC require to process the application to close the case (I know total is 14 months for EB3)

Yes, you need to get the difference in fees. HDFC knows about this and will issue a new colored fee slip.
Thanks Oscarzumaran....do they issue a new receipt number too..? or can I still use my old one just in case if dates open up...?

This issue has gotten media attention not due "new born sympathy" towards immigrants but due to Hispanic politics played by Democrats since hispanics happen to be the majority in the citizenship waitlist!!!
Suddenly, they raise this issue while there are thousands of applications rotting for years. They always see only one side of the coin!!
