The Governor has filed her response to the motion argued in court today to delay the implementation of Arizona's SB1070 law on July 24th. Reader USC has discussed some of the arguments in the comments. In short, Arizona is arguing that illegal immigration is costing the state serious money and delaying implementation will economically damage the state. Once you start working as a trainer, you have violated H-1B status so that you must rely on the EAD for both the gym job and the Systems Analyst position. You must also use Advance Parole, not the H-1B visa, to return after travel.

HI,
I have an H1b approval notice but as it clear the duration of the visa validity starts in October, today being 27 june and three months away from start of visa duration can i travel to India next month ( july) and be back in August as i am still on OPT and working full time in America now. I have got an oppointment with a consulate in India. Once i have got a stamp on my passport will i be permitted to enter back immediately or only in october, i need to make decision to travel now or later as if i am allowed back immediately it will affect my work.

I have an I-485 filed under EB2 category and have used the Advance Parole documents to travel outside US. As a result my I-94 states my status as "PAROLEE".
I recently got my EB1-I-140 (Extraordinary Ability) approved and my lawyer wanted me to apply for a new I-485 saying that transferring a I-485 gets rejected more often.
However, on knowing that my I-94 states that I am a Parolee she tells me that she cannot apply for a new I-485. Is that true?
Urgent response will be greatly appreciated.

My employer was planning on sponsoring me, and paying all the filing fees, but the deal was that I was going to pay the lawyer directly for the legal fees. I just found out from a second lawyer that technically we can't do that because it will drop my salary below the prevailing wage. Is there anything I can do to get around this, and still pay the legal fees? Is it completely against the law for me to pay them or is that just an "interpretation of the law"? The other possibility is my husband could pay the fees, but I don't know if that's allowed either.
Let me know if you have any advice - we have to have everything signed by this Friday.

Yes. The petition will be like a regular change of employer H-1B petition. The lawyers will tell you what documents they need from you when filing the company's H-1B petition.

I do not think so. I believe these are two separate issues and should not have any effect on the chances of your frnd securing visa.

I am a strong supporter of Comprehensive Immigraton Reform (CIR). I have been on both sides of the fence. In the late 1970s and early 1980s, I was an attorney for the Immigration and Naturalization Service. I spent a couple of years representing the government in deportation proceedings, often conducted in Federal prisons. Are there people in the U.S. who should be deported? Absolutely! I was wondering if somebody could help me with a journal/professional association website that my job ad (senior web developer) could be posted.
Any advice is greatly appreciated.
Also I had a question about the employment.
When one graduates from University is he/she eligible to still work for the University while waiting for the OPT?
i.e. graduation date (dec 22) - opt start date (january 17th)

Dependent spouse using EAD does not invalidate your H1 status - If you use EAD then your H1 becomes invalid and your status will be "Pending AOS"

Hello:
I'm Canadian who've worked in US for the same employer under L1 Blanket for almost 3 years, my current L1B will expire at July 2011. I heard a lot of L1 extension get rejected recently, I wonder if I can have a fresh L1B petition (I-129) with another 2 year, then go to US-Canada border and turn around with the fresh L1B petition, so I can stay in US for anther 2 years.
My only concern is that, do I qualify the '1 year working at foreign branch within 3 years prior to admission to US' requirement? considering I've been in US almost 3 years already.
