Immigration legislation in Congress ended on a sour note in 2010. The DREAM Act, after narrowly passing in the House of Representatives, failed to get the necessary 60 votes in the Senate required to overcome a threatened GOP filibuster. Comprehensive immigration reform never even came to a vote in the last Congress. I want to ask whether this new Memo for validity of employer-employee relationship is being questioned in case of Port of Entry for existing Stamped H1b holders who are planning their short visit to go and come back in US.

Hi,
I received RFE on my 485 for I94 copy. My situation is below
I travelled to Tijuana, Mexico from San Diego by road to request
for new I94 at the US Port of Entry at San Ysidro, Tijuana as my old I94
was issued only until PP expiry date but since i already had a valid I94 on H1B notice, The officer didn't issue a new white I94 card even though i requested for one. Also, The officer took my earlier old white I94 card, so i don't have one with me now though i have a copy
of it. Also USCIS is asking for a detailed explanation as to why new I94 was not issued at POE. please advise on how to respond to this RFE

Does anyone have feedback on "Saga Consulting Services"

They say that, they can pay at 90/10 or 80/20
and also pay some amount in "per-diem"
This will make effective rate to be "more than 90%"

Say if one has two I-140 and wish to port the priority from the older one to the later one. And if the USCIS does not agree with your filing(maybe they will say the filing is not possible or not portable). What will they do? Will they deny the I-485 or will they just reject the application. If so will it cause an issue when the later priority date is reached and during the application of the following I-485.

Jul 2nd filer. EAD approved late Sep and notice mailed on 10/2/07. (LUD on EAD 10/2)
There is a LUD on the AP application on 10/4/07, but the status still says case received and pending. What could this LUD be ?
When I saw the LUD (with 10/4) I got excited and thought AP was approved too, but when I click the case details , it still says pending. The text of the details did not change.

My husband and I are in a big Dilemma whether to apply for EAD or AP? In the lawyer's note,it says that anyone who is I-140 Beneficiary will not be able to use EAD and AP. Is it true?
We are on our 3 years H1/H4 using I-140 benefits only. What should we do?
Please guide us.
We still have 3 years remaining. Problem - We both have no visa stamping after we got our extentions which why AP is required at this point?
Are there any travel restrictions after we file I-1485 with AP or WITHOUT AP.
Please highlight. Will be very useful for us.

Hello all. This is a basic question: Are all 501(c) employers exempt from the H1 cap? I have heard and read so much about some non-profits being exempt from the H1 cap, but no one could tell me with certainty which ones.

How much time does it take for 485 to get approved with a visa number available. I applied for 485 after my i-140 was approved. Does the priority date have anything to do with processing for 485?
Nobody know how long it takes to adjudicate I485 once your PD becomes current. A conservative guesstimate would be 6-8 months. The whole processing of I485 is driven by the PD.

1) If A# is not available so we need to populate it with I-94# ? I got
this weird idea from Point 10 of I-765 form where it says A# or I-94#
Of course in other places it just asks A# ( specially in I-131 form)
2) For I-131 there are lot of doubts - want to double check
a) Class of Admission - ?
b) A# is the very first Information sought !!
c) Date of Intended Departure and Expected length of Trip
d) For how many Trips you intend to use
3) In G-325A Bigraphic form also at the end - it again asks for
ALIEN REGISTRATION NUMBER - what is the that ??

Forgot to mention that my I-140 was also approved in Jan 2007. This was not a concurrent filing. I filed I-485 after getting I-140 approved.
