On Nov 8th, Senator Lieberman and 18 of his Senate colleagues, wrote to Michael Chertoff (Homeland Security Secretary) to extend 12 months opt to 29 months exercising his authority.
On Nov 11th, NAFSA President Johnson also wrote to Secretary Chertoff to make this change, endorsing above request.
But so for nothing further has come out.

I am filling out an LCA online for an employer who is hiring someone as an H-1B transfer. I am using iCERT and had a question as I go through the process:
Part E. Attorney of Agent Information
16. Law firm/Business FEIN:
This sections asks me for my law firm tax ID number. However, I am a solo practitioner so do not have a TIN or EIN - I use my SSN for taxes etc.
If I leave this part blank, or put N/A will this make them deny my LCA? I called their help desk, but am waiting (who knows how long) for them to respond.

Hi folks,
My company filed for I-485 on July 2nd and I am yet to get a receipt for the same. I understand that usually it takes 1-3 months to get FP request after filing I-485 but in these circumstances, what should be the expectation for receiving FP request?
The reason for asking is because my wife is tired of waiting to do a job and is planning to go to India and work there until she gets EAD. If she leaves now and we get a FP request in her absence, what are my options?
1) Can I delay the FP appointment?
2) Can I go alone and have myself finger-printed (assuming that wife doesn't want to come back to US, that is, not interested in GC anymore)?
3) How does it impact EAD/AP which have not been filed yet but will be filed after getting the I-485 filing receipt.

Hi,
This question is to all attorneys for their input on whether there will be another window (or something called pre-filing) for all GC applicants waiting for file their I-485. It would be great if there could be 'pre-filing' with eligibility for EAD since H1 renewals are becoming tougher by the minute.
Attorneys please add your comments if there is a probability of this happening and if not is there any way we can request USCIS to consider?

I am transferring my H1B from Employer A to B.
With Employer A, I had my recent H1B extension approved till Oct 31 2011.
I am going to have the period on this transfer as June 1 2009 - Oct 31 2011. (Which will 6 yrs in total on H1B status for me).
I have question on form I-129, "Requested Action" section.
Out of the following options, which one should I "Check":
1. Extend the stay of the person(s) since they now hold this status.
2. Amend the stay of the person(s) since they now hold this status.
Please let me know.

Keep new approved H1 and all related documents with you for POE, also EVL.
I enered POE twice in similar situation as yours without new stamping.
Both times POE (Atlanta) experience was good for me.
I just entered even after new USCIS memo.

My labor is approved in August 2007 and I have approved I140.It is likely that my company might declare chapter 11(bankrupt).I have not yet filed my I1485 yet as dates are not current for my PD.
My question is can I port my I140 to a different company B and extend my H1 based on the approved I140 from company A.
If yes, What documents do I need from company A to get this done.There were some posts which said I cannot port without having my 485 filed and pending approval for 180 days.is this true?

Is my birth certificate needed to invite my parents on visitor visa? Isn't my SSC certificate showing date of birth and both parents name enough?
Birth certifcate is a good document to prove the genuineness of the ties with people you claim to be your parents and whom you are trying to get here.
Its good to show it if you have it. If you are afraid of sending the Original send a US notarised copy.
The intention of the document is to only prove your ties with your parents.
If you do not have one or do not wish to furnish one, you can still try.

If your labor is not approved by June 09, you can extend H1-B based on pending labor for more than 1 year. If it will be approved before June, you will be able to apply I-140 premium processing and then extend H1.
