    Hello all,

    I entered US on a valid h4 visa on june 2007.Filed for a h1b on march 2008 and got and stamped h1 on sep 2008.Cud not find job due to recession.Converted back to h4 on oct 2009.I have following questions

    1) Is it possible to convert back to H1 or fresh H1 ?
    2) will the time period i spent on h4 will be counted for my h1?
    3) When i stamped my h1b earlier(oct 2008) it showed validity till sep 2011.Does that mean I have to apply h4 to h1 before that?
    4) In case if i get a RFE on converting from h4 to h1 Can i stay back on my existing h4 visa?
    5) I havnt ever worked on my H1 will that affect my conversion from h4 to h1 now?

    It will be great if you can answer these questions.

    I am happy to report that the USCIS has approved the P-1B visa application that I filed on behalf of Superman is Dead (http://www.supermanisdead.net/), an Indonesian band, that will be appearing on Warped Tour �09 (http://www.warpedtour.com/warpedtour/index.asp).

    You must have at least two years of post-baccalaureate experience in a high-tech field to be eligible for an H1-b visa, or else have a masters or higher degree. So where did you get your experience? Are you still back in your own country? Working? Or did you just get your bachelor's in the US and are still in the US,

    I have a problem. My Employer want to know how long it`s take to become the EB3 Visa, I meen after PERM, I-140. I`m from Germany. I have read that it`s take 4 years till a visa will be available. It`s really so?

    I have applied for AP (I131) on 8/14/09 and my I-485 got approved on 9/01/09. Is USCIS is going to return my I131 fee or is there anything I have to initiate from my end to get the refund?.

    As long as the job responsibilities and duties match with what you are already performing, it is 100% safe to switch jobs . I had the same issue last year and I spoke with an attorney at Murthy law firm and based on which I started working with the new company. I did inform USCIS and everthing is working well so far.

    Last year I signed affidavit of support forms for my parents and they are already got their immigrant visa. One of my friends needs my help to sign affidavit of support for his brother. My question is how many affidavit of supports one can sign for different people? What are my liabilities if his brother later do some thing wrong in USA?

    If you have a pending permanent residency application you should still be able to work under h1b status, particularly if your i-140 is approved.

    They might increase the no. of H1Bs but might not do any refinement in the immigration process I guess.:o
    So can't say how that would be advantageous but nevertheless the economy is boomin and there are lots of jobz.:)

    Hello,

    Recently I applied for AP. It was approved on Oct 20, 2009 but when I got the document from USCIS I found that the effective date of my AP is from 12/20/2009 to 12/19/2010. My question is,

    1. I want to go to India on 26th Nov and return on 20th December. Some of my friend told me that I can travel between 12/20/2009 to 12/19/2010 not not before 12/20/2009. Is it correct.
    2. My understanding was I can go to India before effective date which is 12/20/2009 and can return on or after 12/20/2009. Is this correct.

    Please respond as I want to go to India on Nov 26th 2009 due to some emergency.

    I applied for I-485, I-140,and EAD almost 2 months ago..The package was received by USCIS but no receipts yet, no checks are cashed yet...We called and they said it may take 3 months to issue receipts...what should I expect?Receipts and approval of EAD in a month given that they usually honor the 3 months period to approve EAD?or nothing is guaranteed!!

    Hi,
    I have not filled for some of my address changes with the AR-11 forms, i was not aware of this. But in the G-325 it is asked for all the address in the past 5 years.

    Will this create any problem. How should we correct this. Anybody has idea.

    22 Democratic Senators are urging President Obama to stop deporting young people who are likely to be eligible for legalization if the DREAM Act passes. The White House has so far rebuffed such requests with the not very believable excuse that it's hands are tied.
