Hello,
I have an "intend to deny" on my GC as EB1 that I got by applying myself as primary and wife as secondary. wife is on h1b and me on h4.we got EADs and if the GC is denied, we will lose the EAD.
I want to incorporate for several reasons hence i will be using the EAD for that.
using EAD invalidates H4 ? but H4 is automatic status based on H1b .
My wife did not apply for GC as primary and me on secondary but we intend to that in 3 years when it becomes current as EB3.

I was wondering if there is a way to efile for renewal of EAD & AP or do we really need a lawyer. It is turning out to be too expensive to file for a renewal through my comany lawyer. If it is possible, can someone who has already self filed advise of the procedure?

I was not sure where to put this question. But would apprecite if anyone can reply to this based on the knowledge they have.

I know a friend who has done Bachelors in Computer Application in india. She is now in US and wanted to know the options for working or studying in US.

Is she eligible to take up MS degree..???
Is she eligible for H1b..???

Any suggestions will be greatly apprecited. I apologize if this questions does not suite this discussion forum.

Hello friends
I have filed the renewal of EAD (based on pening I485) with Texas service center in July 2008. My case has been moved to the regional office in dec 2008 (the notice said for faster processing :)).
Took the infopass in Jan 2009 and the IO could not locate my application at the center but contacted the Texas and said my application waiting on background check.
Contacted the senator. Now they can find my application in regional center.
But they gave the same reason as my background check is pending. They told the senator that they can not discuss any further details.
However the Texas service center says my background check came clean long back.

Do they do background checks for renewing the EAD application?
Can they wait on any background check for 10 months to give a document that is valid for 1/2 years?
what else can I do?

Hi,

I have changed to a new employer using AC-21 recently. I have pro-actively sent AC-21 documentation (new offer of employment, covering letter and supporting docs) to USCIS. Ever since, I am checking my case online. Its about 3 months now that I have sent this info and there has not been any update/LUD on my 485 case so far. I am not sure if my I-485 case has details about my new employment.

I am currently doing my EAD renewal. I am thinking if it will be possible to indicate to USCIS about my new employment. Can you please advice on -
a) if it is wise to do so?
b) How can it be done?

No issues, since her H1B is independent of your I-485. As long as she was in her old job/the job mentioned on her G-325 on the day you filed your app. you should be okay.

I had already gotten my USDOS approval and my USCIS approval for my J waiver. The whole process took less than a month which surprised us! But it was stated on the I-797 that I should start working for my employer within 90days from March 19, which will be June 19. The problem is my training program does not end until June 30. Even if I wait until June 19 to file for my H1B, and if I don't go for premium processing, once they approve it and retro-date it, there will be an overlap from June 19-30. Can I apply for the H1 on June 30 instead (when my J expires) but that will be more than 90 days from March 19? I will appreciate any suggestions. Thanks!

Trying to help Mother-In-Law over from China for visit. Unsuccessful w/ tourist Visa process, so now going for Green Card. Received Notice of Decision against me, unable to establish my Petitioner wife is daughter of Beneficiary Mother-In-Law. No hospital records. Previous evidence was "Notarial Certificate of Relationship." I have just received new evidence "Notarial Certificate of Birth" from civil authorities - along with affidavit from school teacher - I need to file EOIR-29, I think to call it APPEAL, OR IN THE ALTERNATIVE, MOTION TO RECONSIDER - can anyone provide a "go-by" as to what format my letter should take? Is letter format acceptable or is formal pleading format needed?

Time is of the essence, I have to file within 24 hours or give up and pursue DNA testing....

I just got a letter from USCIS saying that I need to get a police clearance(b/c my fingerprints are unclassifiable) within 30 days otherwise it may result in the denial of my application.

I am now out of states working for my U.S. employer's overseas branch and can't go back to US until end of Aug. Is there anyway I can ask USCIS to give me some extention period?
